How is the 23 team going to deal with questionable contents like e.g. the stalking... err "candid" pictures? Is there some board of decision makers who make and watch some rules?

Our attentions is there, and I can assure you that we are all - from a personal point of view - in full agreement with you. I have little knowledge of what is actually legal within Danish and European law, but we have asked our lawyers to look at the legality of publishing these specific photos on 23.
In response to both you and other people in this thread I will say this: 23 is not a porn hosting service and we have no interest in forcing and exploration the boundaries of what is legal and what is not.
I should make a few comments of what we do to keep these incidents to a minimum. First of all, not all users are shown on global pages. This means that some users won't have their photos shown in Just In, on the front page, in searches (unless explicitly asked for) and on global tag clouds. Also, we maintain the rights to mark photos as private, to close photogroups with explicit content, to close accounts with explicit content and generally to moderate the content of 23 to keep everything civil.
As you are noting yourself this is a fine line to walk, and you're also correct in saying that our approach is similar (and has been for the past two years) to flickr's. All we can promise you is that we take moderation very seriously and that we try to keep it to a minimum. And that if anyone feels unfairly censored we will discuss these issues both in private through team@23hq.com and through these forums.
Please remember always, that we mean well and that our only interest is keeping 23 a welcoming place for everyone.

I did a search on the photogroups, looking for one with the subject matter of children or kids. All I can find is a ton of empty photogroups with the subject matter of child pornography. Thankfully they are all empty of photos, but is it possible to have the photo groups closed so that people who are interested in child photography would not be lost amongst these groups.
I understand moderating must be a difficult job when you have so many people generating so much data to sift through.
I have to say, I love your site. I have searched high and low for a photo sharing site. You are one of the few that fit all my key requirements, and they are simple requirements: upload full size photos in an album, email a link to the album to friends, allow friends to download original size photos of the entire album in a zip, work well with iphoto and be reasonably priced. It would be really nice to have an iphoto plug in, but at least I figured out how to browse events in iphoto now. All in all, great work.

Moderation is impossible, at least on our current scale -- we do our very best to delete, ban and keep out inappropriate content, but it's a tough battle. Generally, we are liberal in our view of what is acceptable content, which in turn allows us to be very, very strict in turning out unwelcome content such a porn or even worse matter as you describe. And we use that right to delete content. So: If you find any, report here or report to team@23hq.com -- and we'll do away with the content!

There are pages and pages of these photo groups. So many so that they eclipse the chance of any other group with the subject matter of child showing up in the search results. Here is an example:

The first page actually had some non-porn groups on it, so I skipped to the second page which is entirely titles comprising of questionable subject matter. I don't want to click on them to send you direct links, as I am on a public computer and I don't want any ties to my account with these links. What if people thought I was clicking them in the hopes of seeing photos.
The groups clearly have 0 photos in them, but they do clutter up the search results and any search related to children, kids, child etc almost exclusively returns these search results. I am assuming there are 0 photos because any photos of this subject matter were deleted, but possibly the group didn't get deleted along with the photo. Maybe somebody spam created these groups as they are all titled in a similar manner, often having the name Lolita in them, possibly referring to the classic novel. There is at least 100 of them.

Those groups are all excuses to have comments with spam links in them.
They should all be nuked.
