spam (or not?)

I'm really at a loss this time. Are the comments to http://www.23hq.com/nachbarnebenan/photo/5613816 and http://www.23hq.com/nachbarnebenan/photo/5780870 considered spam? I guess they're from the same person as they are quite close in time and contain the same link.
But it's not directly user-visible so I'm not sure about marking them as spam.
There were similar comments recently but they contained nothing else, so it was easy to plonk them.
Anyone has a recommendation?

No doubt. No content, just an unrelated link. It's spam.
I've removed comments from the IP address and banned the owner from further access to the site.
